Hey Shameless,,,I'm thinkin you is in LUCK,,,,I just googled "Does Power of Attorney end with death in Nebraska",,,and,,,,and, like most states in the USA,,,power if attorney does end upon death and then requires all living heirs to petition to the court for new power of attorney to be decided amongst the living heirs,,,,,,and,,,,and,,,they CANNOT do it with out your signature.If the trk was still in your Daddy's name,,,he is WAY out on a limb on this one. So,,call thet AH and tell him to bring the stolen trk back or you will call YOUR friends ,,the authorities,,,,!!!! Then DO IT,,!! Want me to go get my slingshot and come up and help you,,??? I do think you can put a mechanics lien on it. The gals in the clerk of courts office might help. I did one for the car dealership but this darn weak mind of mine can't remember the circumstances. Again good luck with it.

I'm thinkin most everybody has had questionable things done by kinfolks cause of danged old GREED,,,I did not check out all states,,, According to several articles on the internet,, POA does end upon Death in most States and then has to be re-submitted to the court upon agreement of all the renaining heirs. Shameless,,you might wanna go back to the shop that has the trk and let him know there will be court proceedings to rule on ownership of trk. Best'est thing is "you need an Attorney" to get whatever court order necessary to stop thet dude from selling it if he hasn't already done so,,and then take them unscroupolois kins to court to get evetything else designated. |

I don't think I'd call him or go by and see him. Forewarned in forearmed you know. The grand theft auto is a strong point in your favor and the fact it left your place when you weren't home doesn't look good either. I guess it depends on how much you want to spend on a lawyer and how mean he is. I'd blindside him with as much stuff as I could, and if you do decide to charge for the work you did to it, charge the full limit and then some. Don't allow any court proceedings be in his town. Good old boys you know. And, I'd hit this old boy in the pocket where it will hurt the most, and I still think you could hit them on the land grab thing.

I'm still just flabber ghasted that some one would sell something like that for 165 bucks. Obviously it was a ploy to deliberately piss old Shameless off. Anyone with an ounce of sense would know the true value of that pick up. And what the heck is 165 bucks in this day and age. For that amount, he may just as well have given it to the guy. I guess the guy that bought it Knows what it's worth. I am on board with Joe here; there is legal recourse Shameless could take to get the truck back. But then if it comes back to the estate, I don't know how Shameless could get it transferred to him. I guess the one stockholder feels it's worth 165 dollars, so Shameless pays the estate that amount, and it should be his. darrel

i'm think'in that the dude offered the stockholder scrap price for it and the stockholder thought that was a deal! I been search'in for the original title, I've seen it, just gotta find it. when I do i'll file a stolen vehicle report. I went into the court house to get a copy title, and the stockholder already did that, they wanted to know why a 2nd copy was needed. if I can find the original, that will look awful bad to the stockholder since that will over ride the copy!

Dang Shameless,,,the plot gets thicker don't it,,,??? If he already gots a duplicate title,,,the he HAS TO KNOW that he should NOT have sold the trk as he no longer had legal POA. If I understand what the many articles on the internet are sayin,,,POA ends when your Daddy passed on and ALL living heirs have to decide who will be new POA,,,and all the articles say,,,all living heirs HAVE to agree and sign the new POA. a POA without "all" signatures is worthless,,, call the cops,,,get a rope,,,NAW,,,get two ropes,,and hang him from both ends,,,, I'm in your cawnor,,,, |

It might not be a bad idea to put a bug in the new owners ear as to what is going on and that his name will be involved to if he decides to sell in a hurry. Might be worth telling him you'll give him back his $165 just to sit on the truck for a while

If you parents have passed away, there is no POA. There would be an Executor of the Estate. That persons duty is to execute the terms of the will. That means to divide up the estates assets to the proper parties as spelled out in the will. If certain assests that are part of estate are not mentioned in the will, then it is the executors duty to dispose of those assests in a manner that is most advantageous to estate as a whole, then the proceeds are to be dispersed to the survivors. If an executor is purposly disposing of assests below value, that person is in violation of the law.
Time to contact the Probate Court, your attorney, the DMV, Sheriff, CIA,CFR,USDA,KoC, Salvation Army,Free Masons, whatever it takes! These action must stop post haste.

no I never got a copy of the will, the head stockholder can't find it. he prolly pitched it. as for the truck, I found it, it was in the scrap yard minus my 327 engine and they had crushed it down. the stockholder lied to me when I asked where it went or who got it, said the buyer was gonna restore it.....yeah right. one of these days....I might go to jail!

Ted, the lawyer might have a will in the drawer, and then some fellows just have their wills notarized and without the help of the legal thieves... even at that, those shysters sometimes can be bought off too.... Like the one fellow's father had a made up a will stating all the things that were the wife's would go to the daughters... all the outside stuff would go to the sons, and since the land that the house was built on was originally part of the farm, the son that bought the farm would inherit the 40 acres and the residence. A few years later he passed away. The son had taken care of the old man most of the time until the last few months when he landed in the nursing home, and got taken out of there to the daughter's place some 60 miles away for a short while and back into the hospital and died. The daughter, (and possibly her family because stuff started coming up missing and eventually some was found at the daughters place and at her son's place) got into the old mans house and took the will from the safe. The old man's son went to get the will and was gone. he went to the lawyer they used and he said he had no will on file... now it went into probate court and the answers the daughter and her husband were saying were painted in their favor and the son got real mad at what he was hearing and jumped up and hollered at the sister and her husband, "You lying sons-of-a-bitches!!! tell the truth instead of your lies!" and by that time he was over the table and had this big fellow in a half nelson... Judge was hollering "order in the court!" and then hollered at the secretary to get the security... the old man's son knew what he had just done didn't look good and said "you bastards can go to hell" turned and walked out of the building before the security got there and he went to a friends house and sat down and did small talk for awhile and then said "John, your going to have to do my chores tonight and possibly for awhile"... why's that? "because the law is looking for me... and I better go back and turn myself in." and then told him what happened. John said, "I'll go with you". They went and the son turned himself in and they were looking for him. Since he came in, he ended up posting bond and went home and did his chores. The will never turned up and the son got shafted... and not to long after this ordeal, the daughter 's husband got cancer and went through lots of chemo and had to give up carpentry, then the greedy devious daughter became ill and not in good shape either. Sold their fancy big house and went into a smaller house, and haven't heard anymore of them since. Ted, you suppose if Shameless tries something like that, he will have same results?
