gotta meet with the stockholders Monday/Tuesday/Wednesday in ref to selling the farm. i live on the farm and want to buy 10 plus acres off it to build us a new home. one stockholder went in to the USDA office and had them map out 10.1 acres of creek ground for us! what a guy!!! PffffffT! i also went in and had them map out 2 different ways which came out 11.2 and 12.3 acres. i'm living on about 4.5 acres right now, but the highway right of way is about 16 ft from my deck. we can't sit outside and hear each other in conversation for the traffic going past. i talked to the state about putting up signs to end the engine braking past my house and also not put any of them divots in the roadway in front of the house, they are paving a new roadway out there now. JohnCo has been here, he knows the noise! anyway, we just wanna move back off the roadway some. there's a hill back there and maybe we can build a berm type home, will hafta build a new machine shed too, my others here now...i'll sell or have moved back there. i think my BP is already raising up.

Dale, have you ever gotten a copy of your fathers will? There may be instructions in that will, as to how the disposition of the farm was to be handled.
I tried to follow the science, but it was not there. I then followed the money, and that’s where I found the science.

Well if I were in your shoes right now, I'd already be thinking how to move the workshop and sheds. All bull aside, done that,been there. That is good advice given you to get a copy of any will that exists. Sometimes really good people are shady. Hopefully everything is on the up and up for ya. Just good to keep honest people honest. God willing everything will come out good for you.

What ever you do, don't let them buffalo you. Get a good attorny that isn't in some way attached to them stinkholders.

 Well, Good Buddy,,I got three things for my piece of advice.
   1. Hire a good lawyer not known by the cheats,,,er ,,,(stockholders)
   2. Insist on a copy of the "Last Will & Testament" signed by your Father, if NOT signed and notarized by your Father, ANY will they attempt to present to PROBATE COURT will be  "Null & Void". More importantly, if there is NOT a LEGAL will then the WHOLE ESTATE "has" TO GO TO PROBATE AND A JUDGE WILL DECIDE WHO GETS WHAT AND HOW MUCH,,,,,AND the stockholders do not have any Say So. . Your attorney should verify this to you. Make double sure to inform your attorney AND also the judge know that you have asked for a copy of your Father's will and they have not given you one. That right there will convince the Probate Judge that there may be some underhanded shenanigans going on!! There is NO WAY you should have to settle on just 10 acres!!
   3.From what you have told us, these people have not acted in Good Faith with you,,and you will have to decide for yourself that one of the hardest things in life,,,is to realize and accept that not all family members have YOUR best interests in mind! "I KNOW" as I have had to go thru one and now going thru another with my Wife's family.
   4. I was just recently informed by my attorney that "they" had registered My Wife's Mother's Estate in her "maiden name",,,!! My attorney told me that was a common tactic amongst thieves to attempt to show the court that there was NOT any property listed in her "MAIDEN" name,,,,,,!!
    5. I KNOW, I know I said three things but you are MY Friend and do not want you taken advantage of ,,,cause when I go visit,,this summer,,,I will need a place to stay for a few,,,,em,,,a little time,,cause we gots a lot to talk about,,,,,,Wink
   6. OH,,and you need to make sure you move the Chevy Allis back there FIRST,,,,,Clap

Just keep calm they could be working extra hard, to get you to have the high blood pressure explosion.  I always hate for lawyers to get their grubby meat hooks in anybody's pockets, but this could be a exception. I wish you the best.

thanks ya'll! i hafta go pick one of them up tomarrow at the airport, do you suppose that a couple cement blocks and sum nylon rope would look suspicious while traveling along side the river? lol...kinda weird what goes thru some peoples minds huh? maybe hire a Ukranian with one of them tubes they carry on their shoulders? naw...i'll see what they have to say first...hey...wait....i gots a buddy that has a pitbull that needs a new chew bone!!!!

Dont know your "agreement" with others and the ground.... But if you ALL own part, then it can NOT be sold unless all AGREE to it... That could be your  "leg in the door".

A written will isn't even good for toilet paper if others want to be a 💩 and wants to force things their way. If just one of them files a partition suit and the judge sides with them a sale will be in the works and you will be forced to go along with a sale of some kind. I feel that lawyers are Blood Sucking leeches, however this kind of problems are lawyers playpen and if you don't have a good on on your side you're SCREWED.
If it was fun to pull in LOW gear, I could have a John Deere.

I certainly do not want to add to your stress level, and I am sure that you already know this. I don't know why, but in most cases, all the rotten comes out in at least one family member when it comes to the distribution of an estate. Try to keep the attorneys out of it if possible, they are the only ones that come out ahead. Try to focus on the goal and don't fret the petty things, just think what the trivial things cost at $400/hr and that is the way you have to look at it. Sad but true. Be fair, don't get indignant but stand your ground and if you have to pen anything be very careful they might be citing it back to you in a court of law one day. I truly hope that it all goes the way you need it to.

well....i been in conferences for past 3 days...i PO'd them yesterday when i presented at map of what i wanna keep out of the sale. it's a   parcel that we wanna keep for ourselves, maybe build on it. but they want the big green look at me farmers to have that parcel! we'll see. i have alot of my equipment still here and they want it out! of course nothing i have or do is right! they can't even fathom that i don't text! i might be a millionaire in a few months, or might not be...money isn't everything! this was Gramp's farm and i wanna keep some of it! i don't have many years left and can't believe they've lived this long! lol ...Lars...no i haven't been able to try and get a copy of the will yet...in fact with everything whizzing by me...i forgot about that! we have to get part of it surveyed, it's possible the neighbors driveway is on our propertry. i told them it was a township road, but they don't believe me of course! thanks you all for your thoughts and prayers, i'll try to keep ya'll posted on the goings on....oh....i did about spit my coffee out when one of them stockholders was complaining about a couple raccoons that had invaded his fancy horse barn!!!! i'm think'in they may have been the same 2 coons i turned loose at his place!!! LMAO, i smiled all the way home!!!

Dale, I sure hope you get a copy of that will before any property is sold. Without your eyes reading that will, who’s to say you may actually be the majority shareholder of that farm? Or, your father may have left instructions that the farm is to operated as ‘You’ see fit, with profits dispersed every year. You may be the sole inherent of the farm. Those ‘stockholders’, would sell you down the river.

Shamers, a bit of advice. I always carry at least a little pocket size note pad, have for over 40 years. IF I'm going to a meeting always write down my questions and any important facts a day or so before. I'd try to get a copy of that will, in Iowa a copy'd be on file @ Courthouse. I've been executor on 4 estates for relatives. 
 My last job of 24 years it was a necessity. Carried a 3 ring binder to ALL meetings. 
 I used to rent from a really nice old man, then 3 years from his 3 highly educated ones; 2 college professors ( 1 farm management & 1 veterinary science ) and 1 lawyer. It kinda pissed a couple of them when I had info wrote down. I also if they called and said "we want to talk with you" always asked on what subject ?
