WD45 brake lock won't stay locked?

So the brake lock on the WD45 has gotten to where when the brakes are locked the petal latch wants to slip back and release the brakes.  The other tractors (WD / WD45) we have, when the brakes are locked they're locked and you have to push the petals and release the petal latch to unlock the brakes.  This one when you push the brake petals and engage the petal latch, if it does hold you can push on the back side of the petals and the petal latch slips back and releases the brakes.  I don't see anything wrong or out of place and have tried adjusting the petal free travel more & less but nothing has helped.  Any ideas?  Thanks!

The pedal latch rod is bent, or it might be the brake/clutch pedals and or cross shaft has to much wear or needs greased and that can let the brake pedals hang up and then release by just a bump or touch of the clutch pedal, or the latch pivot that holds the pedals has to much wear in it.
