The handle is not stuck I can move it back and forth too engage or disengage if I pull back hard on brake it just dogs engine down so brake wants too work I opened cover to examine and something seams too be moving back and forth so kinda lost as too why it won't stop driving seems like if anything it wouldn't drive if out of adjustment

Remove cover, release lever, with screwdriver pry plate away from flywheel and pressure plate. Sounds like it may be low or out of oil. Could have water in oil causing rust.                       MACK

I would guess rust is the problem.  Another guess is the original clutch from a HD5 was used along with the DD engine . I have never seen or heard of them being a run in oil clutch. So verify if in deed it is dry or wet before adding oil.

I have worked on this machine all weekend glad to say I ended up getting it free after taking more than half of everything apart to get in there. screw driver some pb spray not wd40 and a pry bar got it loose is working like new now thanks for suggestions to get me back going again 🙃 it did have water in bottom just enough to spray around so put hole in bottom for drain and vacuumed around inside too clean out
