I was at a farm sale a couple of weeks ago and after the sale we drove down to an AC/AGCO dealer that was closing up shop. On the lot was a 7030 open station that looked pretty good other than the engine was apart. I talked to a mechanic that was working and he told me to call back Monday and talk to one of the owners. So I called Monday and talked to one of the brothers that are still there. He said they had bought the tractor with the engine apart and it had been torn down hecause of a scored piston in one cylinder. I asked what he wanted for it and said $2500 with a good cylinder and piston and a gasket set to put it back together or $6000 if they fixed it. I told him I would call him back that day with an answer. I called back about a half hour later and said I would take it the way it set. I did ask if there were rings in the package to put it back together and he said he would have to check and to call him back Monday. I said once again I would take it regardless of whether there were rings or not. On Monday I called him back and he said after talking to his brother they had decided to fix it themselves and sell it that way. I said we made a deal on Friday and I expected him to honor that deal. He said no money had changed hands so there was no deal. After some heated words I finished my part of the conversation by saying a man is only as good as his word and you're apparently not much good. He responded he didn't care what I thought, I was not getting the tractor.
Did we have a deal? I think so but I come from an era when a man's word or a handshke were all you needed.

I think you had a deal, not that this matters but I think you also talked to the brother that was not the boss or in charge. When he went and told the other brother he had sold the tractor for $2500 he was probably not very popular.

I can see both ways. On your part he should have kept his word but on the other hand everyone has the right to change thier mind for what ever reason it may be. This might not have been so bad if he didn't act like an a**hole. Did he not even say sorry? He may be going to you know where.

If you were dealin with my dad, you'd have had a deal. That said, my wife has taken a hard line stance selling horses. She gets a lot of tire kickers and after "holding" a few for payment that never happened she's got a new policy. The horse isn't sold till it's on the trailer and she has the money. Guess you could have sat down Saturday and written us a bill of sale and paid later, then it'd have been on paper. Curious who the dealer is. Didn't know there was going to be one less in the area.

Good thing about this post, I figured out a few I wouldn't deal with. Here's my thoughts and how I do it. You tell me you want it, pay me as agreed (something mutually acceptabel to both) and it's yours. Don't pay me as agreed and it's for sale again.

If I was a steady customer I would expect them to hold the tractor on my word. If I had not dealt with them a lot, or perhaps ever, I would have initiated payment discussions when I made the deal. With no discussion of when and how payment would be made I would have to assume the phone call was simply another tire kicker.
Communication is important in any transaction. Just because I believe I have all the details straight in my mind doesn't mean I have articulated same to another. |

I have sold my one B for 800 bucks three times. The last time was this fall. The fellow said he would be back in three weeks with the money. four wees ago he stopped in and wanted to drive it around which he did. Said he would be back in three weeks with the money to pleas not sell it to anyone else. If he happens to come back some time in the spring with the money and the tractor is gone you can bet he will be saying I am the bad one for selling it out from under him. I have never once told him yes after he has made those statements.
I think it is funny. I think these guys are in earnest at the time. Dreams are bigger than the pocket book. This last guy has small kids. He is probly making the wise choice not buying the tractor even though it is one of his wants. Might be different if I needed to sell it real bad. |

you no what really sucks is when a person call you and says his mother just died and he has enharited all of her money and land. and says he's out of money and he's got a old allis-chalmers and sell it to you for 800 you pay him then go back the next week to get it and he says he ran out of money and hauled it off after he's sold all of his land for a good bunch of money you no about (350,000) or so not much lol . and hiss parents ppl have had the land for a good 100 years worked hard to keep it and he gets it and the first ting he does is sell it......SORRY SOB BUT THATS JUST WHAT I THINK

acd21man, I like those kind of people, they make for a good deal for the rest of us now and then. The boy has a problem, substance, alcohol, gambling? None of those are diseases by the way, just stupidity and the lack of willpower.
I have a former friend that was helped by his family all thru his life. He would get the max that could be gifted per the IRS every year. Some of my bad years he was given not too much less than I made. His second parent died a couple years ago and sounds like he got around 1.5 million and in no time lost half of that in the stock market, then was bragging about it when we bumped into them at a restuarant. Laughs at me because we put all we can in real estate. They take world tours, cruises, etc and have told their two sons there will be nothing for them. Notice I said former friends.

This thread could end up irritating me more than the actual nontransaction already has so this will be the last I say about it. Brad MI, you don't know me and I don't know you so I'll just say, what part of "I'll take it do you not understand?" It was his request to call on Monday, not mine, they were a dealer so I assumed he is straight. If he asked me to drive down there on Friday with cash, that was what I would have done. I've been called a lot of things, tire kicker is not one of them. You could ask my wife on that one.
I know I asked for opinions and that's what I got. Some I agree with, some I don't. Everything is a learning experience.

Be thankful he backed out. For 3500.00 you can find one with cab and air that is running. If it scored a piston, it has orings leaking around the sleeves so needs a engine rebuild. Not cheep today. MACK

I'm not pointing a finger at you Burt, just agreeing with your post just prior to mine! There are two possible situations in your story that I can see. Either there was a misunderstanding, in which case better payment detail and communication would have served everyone better on the initial contact, or he thought better of his offer and backed out. Since he clearly stated that after discussing it with his brother they had decided to go another route it seems clear that he was willfully reneging on his agreement with you. Perhaps his brother was the real owner of the tractor and he had no authority to make the "as is" offer or who knows what transpired on his end that made him act as he did. The fact remains it was HE who made the offer to you and HE was the one who backed out after you accepted. He made an offer and you accepted; deal done unless payment terms are not met. In your post he didn't question your payment, only his discussion with his brother as the reason for backing out. Also, I'm a little confused about the time line. Your story goes from calling Monday, calling a half hour later to Friday to Monday. Did I read it worng or did 5 days or perhaps even 7 days laps between communications? Brad, you're right, I did mess up the time line. Looked at it Saturday, called Monday and we made the deal, he said call back next day (Tuesday) and he unmade the deal.

yeah...i told a guy that i would buy his 6 row planter at a price we both agree'd on, went the next day to pick ip up and he said he talked to an equipment dealer and they told him a price they would sell it for! now he wants that price!...i let him keep his planter! he still has it, and it's been 2 years ago now. he still wants that price! it's just sitting there outside rusting away now, it was a nice shed kept planter before that!
