That is why it is best to haul out the item at time of purchase. Some sellers will refund your $ while you arrange transport b/c someone else offered much more after you shook on the deal.
Yes, you may win in small claims court against seller (always get title/BoS). Will you ever collect the judgment? GOOD LUCK. Is it worth the hassle?
Take item when you buy it - even it means drag it down the road somewhere (try to get permission to park it) for a few hours while you get trailer. (Park, McDonald's, and nearby farmer's field worked for me.)
